Who can apply

Puede presentar la solicitud quien pretenda registrar una marca. Si la solicitud se presenta mediante representante o por una persona jurídica, pueden exigirse documentos adicionales de representación o autorización.

What you need

Como mínimo, la fase formal exige solicitud, representación del signo, datos del solicitante, lista de productos/servicios por clase y comprobante de pago de la tasa (desde 100 € hasta un máximo de 980 € según el número de clases de Niza). Si se actúa mediante abogado, se requieren poder notarial y comprobante de honorarios del abogado. Si el solicitante es persona jurídica, se requieren documentos de autorización societaria.

The process (3 stages)

La solicitud pasa por tres puntos principales: determinación formal de admisibilidad y fecha de depósito, examen sustantivo sobre motivos absolutos, y registro final una vez vencida la oposición.

Formal admissibility and filing-date grant

The Trademarks Directorate reviews whether the filing meets the minimum legal elements required for recognition as a trademark application. A compliant filing receives a filing date. A deficient filing receives a cure notice with a 30-day correction period; failure to cure leads to archive.

Trademark filing request submitted through the electronic filing portal.Representation of the sign for which trademark protection is sought (visual, verbal, sound, or other form). Substantive examination on absolute grounds

The trademark examiner assesses the filing against the absolute grounds for inadmissibility. If accepted, the filing is published and exposed to opposition; if rejected, the filer receives an appealable adverse decision.

Final registration in the Trademark Registry

Once the opposition period has elapsed without opposition, the competent registry officer enters the mark in the Trademark Registry. The filing procedure closes and the ten-year protected-right state becomes operative.

Your rights

Si el expediente es archivado o rechazado, existen vías de impugnación. Si la solicitud es aceptada, terceros pueden formular oposición dentro del plazo legal antes del registro final.

FAQ

¿El derecho nace al presentar la solicitud?
No. Primero debe obtenerse la fecha de depósito, luego superar el examen sustantivo y después cerrar la ventana de oposición antes del registro final.

¿Qué ocurre si la solicitud tiene defectos formales?
Se abre un plazo de subsanación de 30 días. Si no se corrige dentro del plazo, el expediente se archiva.
